OFFICIAL RULES


To enter this Contest, you must agree to and abide by these Official Rules.

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. INTERNET ACCESS, A VALID E-MAIL ACCOUNT, AND A VALID FACEBOOK, TWITTER, OR INSTAGRAM ACCOUNT ARE REQUIRED.

  1. Eligibility: The Stetson New Rules of Chivalry Contest ("Contest”") is open only to legal residents of the fifty (50) United States and District of Columbia, who are at least 21 years of age, who have Internet access, an active e-mail account, and a valid Facebook, Twitter, or Instagram account as of date of entry. Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months prior to the start of the Contest, performed services for Sponsor, Administrator, Thismoment, or any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest or supplying the prizes, and/or their respective parent, subsidiary, affiliated and successor companies, and immediate family and household members of such individuals, are not eligible to enter or win prize(s). "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. "Household members" shall mean people who share the same residence at least three months a year, whether related or not. Void where prohibited by law.

 

  1. Contest Schedule: The Contest begins on or about 05:00:01 p.m. Eastern Time (“ET”) on 10/15/2014 and ends at 11:59:59 a.m. ET on 11/21/2014 (“Contest Period”). Thismoment’s computer is the official clock for this Contest. Four (4) separate and distinct Contest Entry Periods (also referred to as “Weekly Periods”) and a Grand Prize Period comprise the Promotion Period as set forth in the chart below.

  1. Contest Entry:

 

Navigate the Internet to www.stetsoncologne.com/newrulesofchivalrycontest.com (“Website”)

 

Step 1 (Upload Photo or Video): Upload a photo or video from your computer, your Facebook, or your Instagram account that relates to one of Stetson’s 10 New Rules of Chivalry (as posted on the Website). Regardless of where you upload your photo/video from, you will be required to link your entry to your Facebook, Twitter, or Instagram account to complete your submission. If any other persons appear in or were involved in the creation of your photo/video (including without limitation person(s) who appear in a photo/video and/or the photographer/videographer who took the photo/video), you agree that prior to submitting your Entry (as defined below), you have obtained the written consent of such person(s) (in the case of a minor, you have obtained the written consent of the minor’s parent/legal guardian), granting the Sponsor and its designees the use of each person’s name, biographical information, image and/or likeness for advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet (including without limitation, for posting on the Website in connection with the Contest), and in perpetuity by the Sponsor and its designees, without compensation (except to the extent prohibited by law) or additional consents and without prior notice, approval or inspection, and to execute specific written consent to such use if asked to do so. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from you at any time. Failure to provide such proof, if requested, may result in your disqualification, at Sponsor’s sole discretion. All use of the word “photo” and “video” includes the accompanying Short Essay as well (as discussed below).

 

Step 3 (Provide Information): Provide your email address and name.

 

Step 4 (Short Essay): Write a brief explanation, up to five-hundred (500) words, describing how your photo/video relates to your Rule selection in Step 5 below.

 

Step 5 (Choose a New Rule of Chivalry): From the provided 10 New Rules of Chivalry, select the one (1) Rule that relates most closely to your photo/video.

 

Carefully read the Official Rules, then click the check box signifying that you have read, fully understand and unconditionally consent and agree to these Official Rules.

 

IF YOU DO NOT CHECK THE BOX INDICATING YOUR AGREEMENT TO THE OFFICIAL RULES YOU WILL NOT BE ELIGIBLE TO PARTICIPATE IN THE CONTEST OR WIN PRIZE(S).

 

An “Entry” consists of an individual’s registration information, his/her photo or video submission, his/her New Rule of Chivalry choice and his/her description of how photo/video relates to chosen New Rule of Chivalry. Incomplete submissions will not be accepted. To submit your Entry, click the "Submit" button on the entry form. Proof of entering information at the Website is not considered proof of delivery to or receipt by Sponsor of such Entry. Thank You Page merely indicates that your Entry has been received but does not constitute any representation that such Entry is eligible for the Contest.

 

If Sponsor/Administrator determines, based on their preliminary, non-binding review, that your Entry is eligible under these Official Rules, the photo/video portion of the Entry will be posted on the Website for purposes of public voting. See Rule 8 below. Sponsor/ Administrator will seek to promptly conduct the preliminary review and thereafter post photos/videos, but Sponsor and Administrator expressly disclaim any and all liability in conjunction with the timeliness of such preliminary review including any delay in posting photos/videos on the Website.

 

If photo/video is posted on the Website, entrant understands and agrees that (a) the posting of photo/video is subject to technological, electronic, programming and other limitations/malfunctions and the photo/video as posted may not be exactly the same as the photo/video submitted by entrant as part of his/her Entry; (b) his/her photo/video may be posted by Sponsor/Contest Administrator in any order, format, sequence or pattern, which may or may not be altered or varied by Sponsor in its sole discretion one (1) or more times during a given weekly period.

 

FOR ALL PHOTOS/VIDEOS POSTED ON THE WEBSITE, THE PHOTOS/VIDEOS REPRESENT SOLELY THE VIEWS/OPINIONS OF THE INDIVIDUAL ENTRANT AND DO NOT REFLECT THE VIEWS/OPINIONS OF SPONSOR IN ANY MANNER. SPONSOR IS ACTING AS A PASSIVE CONDUIT FOR THE POSTING/PUBLICATION OF PHOTOS/VIDEOS AND HAS NO OBLIGATION AND EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY IN CONJUNCTION WITH SCREENING, MONITORING, OR REVIEWING THE CONTENT OF PHOTOS/VIDEOS. SPONSOR WILL NOT EDIT PHOTOS/VIDEOS PRIOR TO POSTING THEM ON THE WEBSITE FOR PURPOSES OF THE CONTEST.

 

You may be asked to consent to receive promotional e-mails and reminders for upcoming Sponsor promotions. Consenting to receive promotional or reminder e-mails is optional, does not have to be agreed to in order to be eligible to enter the Contest, and does not improve your chances of winning. In the event you do consent to receive these e-mails, the use of such e-mails shall be subject to the privacy policy of Sponsor and you may opt out of receiving these e-mails at any time. Once submitted Entry becomes the sole property of Sponsor to the extent permitted by law and cannot be modified by entrant. By submitting an Entry, entrant gives permission (and warrants and represents that he/she has obtained all rights necessary to give such permission and grant the license herein described) to Sponsor and its designees and hereby grants Sponsor and its designees a royalty-free, irrevocable, perpetual, worldwide, sub-licensable, non-exclusive license (herein “License”) to post entrant's photo/video, name, likeness or image, and all other information about the entrant contained in the Entry on any media and through any means now known or hereafter devised, including without limitation, the World Wide Web, and to otherwise use entrant's name, likeness and all other information about entrant in the Entry, and make derivative works therefrom, without compensation in accordance with the requirements of this Contest and the advertising, promotion, and publicity of the Contest, Sponsor’s products and services, and otherwise, as stated in these Official Rules (as solely determined by Sponsor).

 

  1. Additional Entry Rules and Restrictions: Limit one (1) Entry per person/email address per Weekly Period. Do not submit the same photo/video for more than one (1) Weekly Period. Multiple entries and/or mass entry attempts in violation of the preceding limitation will result in disqualification of all entries by such person/email address. Entries must be manually keystroked by the Entrant; use of automated entry devices or programs and entries by third parties by any method of entry are prohibited. Entries that do not conform to or that violate these Official Rules or are submitted in any manner other than stated in these Official Rules will be disqualified. Sponsor and Administrator will not be responsible for late, lost, incomplete or misdirected entries. By entering this Contest, entrants agree to these Official Rules and the decisions of the Administrator and Sponsor, which are binding and final in all matters relating to this Contest. In the event of any dispute concerning the identity of any entrant, the Entry will be deemed submitted by the natural person who is the authorized holder of the e-mail account used for Contest entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. No entries may be effected on behalf of someone else.

 

  1. Content Guidelines: In addition to complying with all other requirements of these Official Rules and/or on the Website, each photo/video must comply with the following guidelines (“Content Guidelines”). Any Entry which includes a photo/video that Sponsor, in its sole discretion, determines is in violation of any Content Guideline will be disqualified. Each Entry must not:

 

Š       Contain content that violates or infringes any third party rights of any kind, including without limitation, any third party privacy, publicity, trade secret and/or intellectual property rights, including third party registered and/or common law copyrights and trademarks;

Š       Name the fragrance, brand names, trademarks or logos of any third party other than products manufactured by or for Sponsor**;

Š       Contain content that is misleading, inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous or libelous;

Š       Contain content that reflects, advocates or promotes bigotry, racism, hatred, harm or exploitation of or against any class, group or individual, discrimination based on race, gender, religion, nationality, disability, sexual orientation or age, or actions or activities that are restricted, prohibited, illegal or unlawful (including without limitation, the consumption of alcohol or other controlled substances);

Š       Contain content that is unlawful or in violation of or contrary to any applicable federal or state laws or regulations;

Š       Have been previously submitted in a promotion of any kind, or published, posted, exhibited or displayed publicly for commercial use.

 

In addition to the foregoing, the Entry cannot:

 

Š       Contain executable programming of any kind, including without limitation, viruses, worms, Trojan horses, spyware, malware, time bombs, Easter eggs, cancel bots or any kind of malicious or benign computer programming whatsoever; and

Š       Contain encrypted content of any kind, including without limitation, encoded messages.

 

**Sponsor grants to each qualified entrant a limited, non-transferable, non-exclusive, non-sublicensable, revocable right to use its and/or its licensor's trademarks and/or other content solely for purposes of and limited to their entry/entries submitted in this Contest; such right and license will automatically expire without further act of any party at the expiration of the Promotion Period, unless specifically extended on an individual basis by Sponsor in writing in its sole discretion. Any other use of Sponsor’s and/or its licensors’ trademarks will be a violation of Sponsor’s or its applicable licensors’ intellectual property rights.

 

  1. Judging/Fan Voting: Fan voting will be open from the start of each Weekly Period until 11:59:59 a.m. ET on the Friday following the end of that Weekly Period. It is therefore suggested that persons submit Entries prior to the end of a weekly period so as to allow time for Sponsor/Administrator to conduct their preliminary review of photo/video and post same on the Website if determined to be eligible. Judging will be conducted on or about 12:00:00p.m. ET the Friday following the end of each Weekly Period. All eligible Entries received and recorded during the Contest Period will be judged by a panel of judges as determined by Sponsor based on the four (4) following criteria: Relevance to Objective of Contest (40%); Creativity/Originality of Entry (20%); Overall suitability of entry for promotional purposes (20%); and Fan voting (20%). The entrant with the highest score will be considered the Weekly Prize winner for the applicable Weekly Period. The (verified) Weekly Winner (from among four (4) verified Weekly Winners) whose Entry received the highest percentage of total, valid fan votes (as compared to the other verified Weekly Winners) during the applicable Weekly Period (as tabulated by Administrator) will also win the Grand Prize. In the event of a tie, the verified Weekly Winner whose Entry from among all such tied entries with the higher/highest score in the “Relevance to Objective of Contest” criterion will be declared the Grand Prize winner. The determination of the Grand Prize winner will take place on or about 12/3/14.

All non-winning entries for a given Weekly Period will NOT be carried forward to subsequent Weekly Periods, as applicable.

 

Regarding Public Voting: Votes must be manually key-stroked in accordance with the instructions on the Website; such instructions are made a part of these Official Rules and incorporated by reference herein. Use of automated or programmed voting methods is prohibited and any votes garnered by such means will be voided. Use of device or artifice to manipulate or compromise the integrity of the voting procedure will result in voiding of votes deemed by Sponsor/Administrator in their sole discretion to have been affected by such actions and/or disqualification of entrants whose entries benefited from such actions and/or other legal sanctions.

 

Voting totals are for informational purposes only and actual vote count may vary.

 

Decisions of the judges and Administrator are final and binding in all respects.

Grand Prize winner and Guest must travel 3/19/15-3/23/15, or prize will be forfeited without compensation of any kind and at Sponsor’s discretion, awarded to an alternate winner. Actual value of Grand Prize trip may vary based on point of departure. Travel arrangements must be booked through Sponsor’s agent, on a carrier of Sponsor’s choice. Guest of Grand Prize winner must 21 years of age.

Grand Prize winner and Guest are solely responsible for obtaining travel insurance and any and all necessary travel documents (valid photo I.D., credit card, etc.). Grand Prize winner and Guest must provide own transportation to and from departure airport. Winner's Guest must sign and return a Liability Release/Publicity Release (where lawful), prior to issuance of travel documents. Changes not permitted after tickets are issued. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. Winner is solely responsible for all costs and expenses not specified herein as being awarded, including, but not limited to, meals, tips, hotel incidentals and additional ground transportation. Grand Prize winner and Guest assume the risk of any inherent or unforeseen dangers associated with travel, except that this will not relieve any Released Party from liability for personal injury or death caused by its negligence. Sponsor is not liable for any expenses incurred as a consequence of flight cancellation/delay. If Grand Prize Winner and Guest cannot comply with these restrictions or any other portion of these Official Rules, the Grand Prize will be forfeited in its entirety and an alternate winner will be chosen from among the remaining verified Weekly Winners as set forth in Rule 8 above.

 

No substitution, transfer or cash redemption of prize except Sponsor in its sole discretion may award a substitute prize/prize component of equal or greater value if advertised prize/prize component is unavailable at time of awarding. Unspecified expenses relative to prize acceptance/use are winner’s sole responsibility. Gift card portion(s) of Prize for weeks 1, 2, 3, and 4 are subject to terms and conditions thereon. All federal, state and local taxes are the sole responsibility of the winners, who will receive an IRS Form 1099 reflecting the final actual value of prize(s) valued at $600 or more. All prize details are at the sole discretion of the Sponsor. Prizes must be accepted in their entirety as stated herein or not at all. Limit of one (1) Weekly Prize per person/family/household.

 

10. Winner Notification: Potential winners will be notified via email on or about the third business day following the conclusion of the voting period for their Weekly Entry Period. Grand Prize winner will be notified via email/phone on or about 12/3/14. Failure to respond to the initial verification e-mail within seventy-two (72) hours after notification or return of e-mail notification as undeliverable after two (2) attempts will result in disqualification. Potential winners for Weekly Periods three (3), four (4) ,and the Grand Prize Period will be required to sign and return, within seventy-two (72) hours of notification, an Affidavit of Eligibility, Release and Indemnification, and a Publicity Release where allowed by law. If the Affidavit of Eligibility, Release and Indemnification and Publicity Release (where allowed by law) are not returned to Sponsor within the specified time period, potential winner may be disqualified. If a potential winner is disqualified for any reason, potential winner’s prize will be forfeited without compensation of any kind. If potential winner forfeits weekly prize, the entrant with the next highest overall score using the judging criteria above for the applicable weekly period will be deemed the potential winner for that week. If verified weekly winner forfeits Grand Prize, the verified weekly winner with the next highest percentage of total, valid fan votes (as compared to remaining verified weekly winners) will be deemed the potential Grand Prize winner.

11. Limitations of Liability: Released Parties (as defined below) are not responsible for lost, late, incomplete, stolen, misdirected, illegible, inaccessible entries/photos/videos, Internet connections or email; or for any computer, telephone, wireless, satellite, cable, network, electronic, Internet or phone hardware or software malfunctions, failures, connections, or availability, or garbled, corrupt or jumbled transmissions, service provider/Internet/website/use net/accessibility, availability, or traffic congestion, Internet contact, or any technical error, or program errors or malfunctions or unauthorized human intervention, or the incorrect or inaccurate capture of Entry, photo/video or other information, or the failure to capture, or loss of, any such information. The Released Parties (as defined below) are not responsible for any incorrect or inaccurate information, whether caused by Website users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Contest and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to the Web site (or any other web site). If for any reason the Contest is not capable of running as planned (in whole or in part), as solely determined by Sponsor, including but not limited to by infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures that can corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest. In such event, Sponsor shall conduct the Contest and award the prizes in a manner which is fair, appropriate and consistent with the spirit of these Official Rules, as determined by Sponsor in its sole discretion. Notice of cancellation/termination/ modification/suspension of the Contest will be posted on the Website. The right is reserved by Sponsor to disqualify any individual found, at its sole discretion, to be tampering with the Entry process or the operation of the Contest or Website, to be acting in violation of the Official Rules, or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Released Parties are not responsible for any injury or damage to entrant's or any other person's computer or device related to or resulting from participation in or downloading any materials from this Contest.

 

Entrants further agree not to knowingly damage or cause interruption of the Contest and/or prevent others from participating in the Contest. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE OR AN INDIVIDUAL OTHERWISE ATTEMPTS TO DEFRAUD SPONSOR, SPONSOR MAY DISQUALIFY ANY ENTRANT MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW.

 

12. Additional Conditions: By participating, entrants agree to be bound by and abide by these Official Rules and the decisions of Sponsor and/or Administrator, which shall be final and binding in all respects. By participating in this Contest, agree to release and hold harmless Sponsor, Administrator, Thismoment, Facebook, Twitter, Instagram, their respective parent, subsidiary, affiliated and successor companies, advertising and promotion agencies and prize suppliers, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage (whether due to negligence or otherwise) to person(s), including death, and property or breach or failure or any representation of warranty arising in any manner, directly or indirectly, from participation in this Contest and/or from the acceptance misuse or use of any prize. By entering, entrant authorizes the Sponsor and its designees to use entrant’s name, voice, likeness, photograph, prize information, biographical data and city and state of residence in programming, advertising, trade and/or promotional material and on a winners’ list (if applicable) in all media now known or hereafter discovered, world-wide and on the World Wide Web and Internet, at any time, in perpetuity, without additional compensation (where permitted by law) and without review, approval or notice, to the extent permitted by law. Sponsor is not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor’s sole discretion, without further obligation or compensation.

13. Disputes: Arbitration/Choice Of Law: To the fullest extent permitted by law, entrants agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Contest, or any prize awarded, or the determination of the winners, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective, and (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Released Parties in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of New York, without regard for conflicts of law doctrine, and all proceedings shall take place in the City of New York, County of New York.

 

14. Winners' List: For the names of the winners mail a self-addressed, stamped envelope to: Stetson’s New Rules of Chivalry Contest Winner’s, c/o LeadDog Marketing Group, 440 9th Ave., 17th Floor, New York, NY 10001. Requests received after 11/28/14 will not be honored.
